Scope of this Privacy Notice

This Privacy Notice (“Notice”) describes the types of personal information that Federal Hearing and Appeals Services, LLC (“FHAS,” “we,” “us,” or “our”) collects through our website, (the “Site”). The purpose of this Notice is to provide users of our Site with information about the nature, scope, and purpose of the personal information we collect, use, and process and to advise users of their rights. By using our Site, you accept and expressly agree to our practices surrounding the collection, use, and sharing of your personal information in the manner described in this Notice. We collect certain types of information from and about users of our Site, including information:

  • By which you may be personally identified, such as name, postal address, email address, telephone number, company name, or job title (“personal information”);
  • That is about you but individually does not identify you; and/or
  • About your internet connection, the equipment you use to access our Site, and usage details.

We collect this information:

  • Directly from you when you provide it to us.
  • Automatically as you navigate through the site. Information collected automatically may include usage details, IP addresses, and information collected through cookies and other tracking technologies.

Information You Provide to Us

We may collect the following personal information through our Site:

  • Information that you provide by filling in forms on our Site. We may also ask you for information when you report a problem with our Site.
  • Records and copies of your correspondence, such as email address, if you contact us.
  • Your responses to surveys that we might ask you to complete for research purposes.
  • Details of transactions you carry out through our Site and of the fulfillment of your orders. 
  • Your search queries on the Site.

Automated Information Collection

You consent to our collection and use of certain information about your use of our Site through tracking technologies or by other passive means. This “passively collected” information includes, but is not limited to, the domain name of the website that allowed you to navigate to our Site, search engines used, the internet protocol (IP) address used, the length of time spent on the Site, the pages you looked at on the Site, other websites you visited after using our Site, your type of internet browser, the frequency of your use of our Site, and other relevant statistics, including the following:  

  • Log Information. When you access our Site, you also consent to our servers automatically recording information that your browser sends whenever you visit a website. These server logs may include information such as your web request, IP address, browser type, browser language, the date and time of your request, your computer operating system, mobile device and mobile operating system, name of your internet service provider or your mobile carrier, and one or more cookies (small text files containing a string of characters) that may uniquely identify your browser. Our servers also automatically record what you click on while using our Site. 
  • Links. Our Site may include links in a format that enables us to keep track of whether these links have been followed by IP addresses. You consent to our collection and use this information to improve the quality of our Site.
  • URLs. When you use our Site, you consent to our receipt of the URL of the website from which you came and links you click on to leave the website.  
  • Cookies. When you consent to our use of one or more cookies (small text files containing a string of characters) to your computer that uniquely identifies your browser. We use cookies to improve the quality of our Site by storing user preferences and tracking user trends. Most web browsers accept cookies automatically but can be configured not to do so or to notify the user when a cookie is being sent.   • Web Beacons. Web beacons (also known as “pixel tags” or “clear GIFs”) are 1×1 single-pixel graphics that allow us to count the number of users who have visited or accessed our Site and to recognize users by accessing our cookies. You consent to our use of web beacons to facilitate our administration and navigation, to track the actions of users, to compile aggregate statistics about usage and response rates, and to provide an enhanced online experience for users. We may also include web beacons in HTML-formatted email messages that we send to determine which email messages were opened.  
  • Aggregate Information. We may compile certain personal information and other information collected through our Site on an aggregate basis. This information may include, without limitation, the number of people who have visited the Site and other user demographics, including on our software platform. Such aggregate information does not identify you individually.

How We Use Personal Information

Personal information collected through our Site may be used by us for the purposes of: 

  • Responding to your questions and feedback;
  • Providing the services you select through the Site;
  • Contacting you, whether by email, postal mail, or telephone with information about this Site, our products, or our services;
  • Auditing, research, and analysis to maintain, protect, and improve our services;
  • Ensuring the technical functions of our network;

We do not sell, rent, trade, or otherwise share personal information collected from our Site, except as described below: 

  • In Connection with our Offerings. Our Site involves the sharing of certain personal information collected through our services as you provide your consent.  
  • Subsidiaries and Affiliates. We may share personal information with our subsidiaries and affiliates for the purposes that you provided the information or as reasonably necessary for our internal administrative and business purposes.
  • Service Providers. We work with third parties that provide services on our behalf.  Such services may include website hosting, marketing, and website usage analytics. We may share personal information with these third parties for the purpose of providing these services.  
  • Consent. We may share personal information in accordance with any consent you provide.
  • Required by Law.  We may disclose personal information or any information collected through our Site if we are required to do so by law or pursuant to legal process, in response to a request from government officials or law enforcement authorities, or as necessary or appropriate in connection with an investigation of illegal activity.
  • Certain Transactions. We may disclose or transfer personal information or any information collected through our Site to third parties who acquire all or a portion of our business, whether such acquisition is by way of merger, consolidation, or purchase of all or a portion of our assets, or in connection with any bankruptcy or reorganization proceeding brought by or against us.
  • Internet-Based Advertising. We may participate in interest-based advertising. This means that you may see advertising on our Site tailored to your activity. We may target ads based on data we have collected, or data provided by third parties alone or in combination with the data we collect ourselves. Third parties, often called “ad servers” or “ad networks,” may place and access cookies, web beacons, or other tracking technology to collect information about your use of our Site.   • Access and delete certain personal information
  • Correct inaccuracies in their personal information, taking into account the nature and processing purpose of the information (excluding Iowa and Utah)
  • Data portability
  • Opt out of personal information processing for:
    • targeted advertising (excluding Iowa);
    • sales; or
    • profiling in furtherance of decisions that produce legal or similarly significant effects (excluding Iowa and Utah)
  • Either limit (opt out of) or require consent to process sensitive personal information

California Privacy Rights

We collect certain categories and specific pieces of personal information about California residents. As detailed above, we may collect this personal information from you and other third parties. We collect, share, and disclose personal information for our business and commercial purposes described above.

  • Access: If you would like to access your personal information or receive information about the categories of personal information about you that we have shared, please contact us via email with your request. We will use your email address to verify your request and communicate with you regarding your request.
  • We will not discriminate against you if you request to exercise your rights detailed above.

Data Security

We employ reasonable security precautions to help protect against the loss, misuse, and alteration of personal information provided on or through our Site. These security measures include Secure Socket Layer (SSL) technology data transmission. However, no method of transmitting or storing data is completely secure. As a result, although we strive to protect personal information, we cannot guarantee the security of any information you transmit to us through or in connection with our Site. If you have reason to believe that your personal information is no longer secure, please notify us immediately by contacting us in accordance with the last section of this Notice.


Children’s Privacy

Our Site is not intended for children under 18 years old, and we ask that children under the age of 18 not submit any personal information to us. If you are a child under the age of 18, you can use the Site only with your parent or guardian.

Our Site is hosted in the United States. All matters relating to our Site are governed exclusively by the laws of the State of Pennsylvania in the United States and not the jurisdiction in which you are located. If you are located outside of the United States and you contact us, please be advised that any information you provide to us will be transferred to the United States and that by submitting information, you explicitly authorize such transfer.
